Evidence against Dr. Eliot P Kaplan
Dr. Eliot P Kaplan is a psychologist practicing in Brooklyn, NY. I have put up this site to outline the illegal and unethical behavior that he engaged subsequent to treating my child. He has refused to release records in violation of state and federal law and has threatened me in an effort to extort me for money.
Summary of Events
My child and I saw Dr. Eliot Kaplan a total of 4 times for family therapy in September and October 2023. Three of these appointments took place in his living room (which serves as his office) and one took place over Zoom.I paid Dr. Kaplan $625 for the first 2 sessions because he said he did not accept insurance. So I was surprised when my insurance company, Anthem Blue Cross Blue Shield, refused to reimburse me for out-of-network coverage stating that Dr. Kaplan was actually in-network. I brought this up to Dr. Kaplan and he admitted he is in-network with some insurance companies. I did not pay Dr. Kaplan for the next 2 sessions and told him he would need to work with Anthem which he agreed to do.From October 2023 until March of 2024 Anthem alerted me numerous times they had tried to reach Dr. Kaplan but that he had refused to work with them or even call them back.In March of 2024 I requested my child's medical records from Dr. Kaplan but he refused to provide them. Dr. Kaplan indicated that he would not provide me with these records until I paid him $625 out of pocket for the last 2 sessions. I told Dr. Kaplan that it was illegal and unethical to withhold medical records even due to a billing dispute. I also stated that it was actually he who owed me money because he took $625 from me out-of-pocket despite having had a contractual obligation to accept only a $20 copay from me and bill insurance for the rest.Not only does Dr. Kaplan continue to refuse to provide my child's medical records he has threatened to make libelous claims to court in my ongoing divorce case if I do not pay him for the final 2 sessions.
First Visits
My child and I saw Dr. Eliot Kaplan for family therapy on September 7th and September 11th of 2023. I paid for these sessions out of pocket because Dr. Kaplan indicated he did not accept insurance.
Submitting to Insurance
I submitted this invoice to my insurance for out-of-network coverage but they denied it indicating that Dr. Kaplan was actually in-network.
Dr. Kaplan admits he accepts insurance
After my insurance company said Dr. Kaplan was in-network I emailed him about this. He admitted he was in network with some insurance. I provided him with my insurance cards and he agreed to submit his bills to insurance.
2 More Sessions
My child and I then saw Dr. Kaplan 2 more times, on September 27th and October 4th 2023. I did not pay Dr. Kaplan for those visits because he agreed he would bill insurance. Since my copay was $20 and I had paid him $625 for the 2 prior sessions I expected he would reimburse me $565 (the $625 I paid him minus $60 in copays).
Dr. Kaplan does not bill insurance
Despite his contractual obligation, and agreement via email, to bill insurance for our sessions, Dr. Kaplan refused to do so.
Dr. Kaplan Refuses to provide medical records
In March of 2024 I asked Dr. Kaplan for my son's medical records. He indicated that he would not provide them until I paid him out of pocket for the final 2 sessions. This is unethical and illegal under both New York State and federal laws.
Dr. Kaplan threatens me with libel
Dr. Kaplan was aware of an ongoing matrimonial (divorce & custody) case between myself and my ex-wife and used this information in an attempt to extort me for payment. He sent an email implying that him he would make libelous claims to the court in order to hurt my standing in this matrimonial case unless I paid him.
